Mold Liability and Home Inspections
One of the biggest concerns for potential homebuyers is whether there is any mold present at the property. As a home inspector, inspecting for mold is outside the scope of a general home inspection. If a home inspector comes across an area that looks like mold, it is extremely important to word it in the report as “Possible Mold”, because we are not mold inspectors. This would be a great opportunity to upsell a mold inspection.
There are a couple of different ways that the inspector can protect their liability from the potential of mold being present in the property. The first thing that every inspector should do is when they are having the client sign the inspection agreement, make sure that they also sign the “Mold Waiver”. This is all done through ISN. Describe to the client that you are not a mold inspector, but if you see anything that looks like it might be mold you will point it out and at that point they could order a mold test.
The second way that the inspector can protect their liability with mold is within the inspection report. In section 17 make sure to properly exclude/delete the limited mold section and use the “Not Inspected” comment.
If the inspector follows these procedures they will be limiting their liability with the possibility of mold being present during the home inspection.
If during the home inspection there are any signs of moisture intrusion the inspector would want to recommend a mold test due to the possibility of mold forming behind walls that can’t be seen by the inspector.
